These Terms & Conditions govern your use of the Paper Cat Audio website, your purchase of products from Paper Cat Audio, and your interactions with our services.

By accessing this website, placing an order, downloading a product, or otherwise using our services, you agree to these Terms & Conditions. If you do not agree to these terms, please do not use the website or purchase our products.

1. About Paper Cat Audio

Paper Cat Audio develops and sells downloadable audio software and related digital products.

References in these Terms to “Paper Cat Audio,” “we,” “us,” or “our” refer to the operator of Paper Cat Audio. References to “you” or “your” refer to the customer, website visitor, or other person using our services.

2. Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction in order to make a purchase from Paper Cat Audio.

If you make a purchase on behalf of a business, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

3. Products and availability

Paper Cat Audio products are primarily digital software products delivered electronically.

We make reasonable efforts to ensure that product descriptions, compatibility information, system requirements, pricing, screenshots, demonstrations, and other information on the website are accurate and current. However, we may update, modify, improve, discontinue, or replace products or features from time to time.

Product appearance, sound, behavior, interface details, included features, and compatibility may change through updates where reasonably necessary for maintenance, improvement, security, or compatibility.

We do not guarantee that every product will remain available indefinitely.

4. System requirements and compatibility

You are responsible for reviewing the stated system requirements, supported operating systems, plugin formats, host compatibility, and other technical requirements before purchasing.

A product’s compatibility information applies to the versions and environments specifically stated on the relevant product page or documentation.

We cannot guarantee compatibility with every computer, DAW, plugin host, operating-system version, third-party application, audio interface, hardware configuration, or future software update.

Where a product is described as supporting only a particular operating system or platform, use on other platforms is unsupported unless explicitly stated otherwise.

5. Orders and payment

All prices are displayed in the currency indicated on the website.

Payment must be successfully completed before access to a purchased product is provided.

You agree to provide accurate billing and payment information and to use a payment method that you are authorized to use.

We reserve the right to refuse, cancel, or refund an order where reasonably necessary, including in cases involving suspected fraud, payment disputes, technical errors, duplicate transactions, incorrect pricing, or abuse of the purchasing system.

If an obvious pricing or technical error occurs, we are not obligated to fulfill an order at the erroneous price. If payment has already been collected, we will provide an appropriate refund.

6. Taxes

Applicable sales tax, use tax, VAT, GST, or similar transaction taxes may be added to your purchase where required by law.

You are responsible for any taxes, duties, fees, or similar charges that legally apply to your purchase and are not collected directly at checkout.

Tax treatment may vary based on your billing location, product type, and applicable law.

7. Digital delivery

Purchased products are delivered electronically through the download or fulfillment method provided at the time of purchase.

You are responsible for providing an accurate email address and maintaining access to the email account used during checkout.

If you do not receive your download or purchase confirmation, contact us and we will make reasonable efforts to restore access after verifying the purchase.

You are responsible for downloading and securely storing any installers, license information, receipts, or other materials made available to you.

8. Refunds

Because Paper Cat Audio products are digital products delivered electronically, purchases are generally final once access to the download has been provided.

Refund eligibility is governed by our separate Refund Policy, which forms part of these Terms.

Nothing in these Terms limits any refund or consumer right that cannot legally be waived.

9. Software license and EULA

Purchasing a Paper Cat Audio software product does not transfer ownership of the software or its underlying intellectual property to you.

Instead, your purchase grants you a license to use the software in accordance with the applicable End User License Agreement (EULA).

The EULA governs matters including permitted use, installation, commercial music use, copying, redistribution, reverse engineering, transfer, and termination of the software license.

If there is a conflict between these Terms and the EULA regarding use of a software product, the EULA controls with respect to that software use.

10. Intellectual property

The Paper Cat Audio website and its contents, including software, source code, object code, graphics, interfaces, logos, branding, product names, written materials, audio examples, visual assets, and documentation, are owned by or licensed to Paper Cat Audio and are protected by applicable intellectual-property laws.

Except where expressly permitted by these Terms or the EULA, you may not copy, reproduce, modify, republish, distribute, sell, sublicense, scrape, extract, or commercially exploit Paper Cat Audio materials without permission.

Purchasing a product does not grant you ownership of Paper Cat Audio trademarks, branding, visual assets, software code, or other intellectual property.

11. Your music and creative output

Unless otherwise stated in a product-specific license, Paper Cat Audio does not claim ownership of music, recordings, compositions, sound design, or other creative works you produce using our software.

You may use output created with properly licensed Paper Cat Audio software in personal and commercial creative projects, subject to the applicable EULA.

You remain responsible for ensuring that your own projects do not infringe the rights of third parties.

12. Prohibited use

You may not use the website, store, products, or services in a manner that is unlawful, fraudulent, abusive, or intended to interfere with their normal operation.

Without limiting the above, prohibited conduct includes attempting to bypass payment systems or licensing restrictions, distributing unauthorized copies of our software, interfering with website security, submitting fraudulent payment information, impersonating another person, or using automated systems in a manner that materially disrupts the website or services.

13. Third-party services

The Paper Cat Audio website and products may rely on or interact with third-party services, including payment processors, website hosting platforms, analytics providers, operating systems, DAWs, plugin hosts, and other software.

Those third-party services are controlled by their respective providers and may be subject to separate terms and privacy policies.

We are not responsible for outages, changes, discontinuation, incompatibility, or other problems caused by third-party services outside our reasonable control.

14. Updates and maintenance

We may provide updates, patches, bug fixes, compatibility changes, or other modifications to our products from time to time.

Unless explicitly promised otherwise, purchase of a product does not guarantee perpetual updates, support for future operating systems, support for future DAW versions, or development of additional features.

We may discontinue support for older product versions or operating environments where maintaining compatibility is no longer practical.

15. Support

We may provide reasonable technical support for current Paper Cat Audio products.

Support is intended to address issues involving Paper Cat Audio products themselves. We cannot guarantee support for problems caused primarily by third-party software, unsupported hardware, operating-system configuration, DAW-specific behavior, or user modifications.

We may ask you to provide reasonable technical information necessary to investigate a support request.

16. No guarantee of particular creative results

Audio software is inherently subjective and may behave differently depending on source material, gain staging, processing chains, host software, settings, and other factors.

Product descriptions, demonstrations, audio examples, and marketing materials are intended to illustrate possible uses or characteristics of a product. They are not guarantees that you will achieve identical sounds or creative results.

17. Disclaimer of warranties

To the fullest extent permitted by applicable law, Paper Cat Audio products and services are provided on an “as is” and “as available” basis.

We make no guarantee that the website or software will always be uninterrupted, error-free, compatible with every environment, or suitable for every particular purpose.

Where applicable law provides warranties or consumer protections that cannot legally be excluded, those rights remain unaffected.

18. Limitation of liability

To the fullest extent permitted by applicable law, Paper Cat Audio will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of or inability to use the website, software, or services.

This includes, where legally permitted, loss of profits, loss of revenue, loss of data, loss of recordings, project downtime, loss of business opportunity, or damage resulting from third-party software or hardware incompatibility.

To the fullest extent permitted by law, Paper Cat Audio’s total liability arising from a particular purchase will not exceed the amount you paid to Paper Cat Audio for the product giving rise to the claim.

Nothing in this section excludes liability that cannot legally be limited or excluded.

19. Backups and data

You are responsible for maintaining appropriate backups of your projects, recordings, presets, settings, installers, and other data.

Before installing software updates or making significant changes to your production environment, we recommend maintaining appropriate backups and restore options.

Paper Cat Audio is not responsible for data loss caused by circumstances outside our reasonable control, subject to rights that cannot legally be waived.

20. Suspension or termination

We may suspend or terminate access to services or revoke a software license where permitted by the applicable EULA if a user materially violates these Terms, engages in fraud, distributes unauthorized copies of our software, or otherwise abuses our services.

Where reasonably possible, we may provide notice or an opportunity to correct the violation before termination.

21. Changes to these Terms

We may update these Terms from time to time to reflect changes in our products, business practices, legal obligations, or services.

The updated version will be posted on this page with a revised “Last updated” date.

Changes will apply prospectively unless applicable law requires otherwise. The terms applicable to a completed purchase will generally be those in effect when that purchase was made, except where a later change is required by law or agreed to by you.

22. Governing law

These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict-of-law principles, except where mandatory consumer-protection law in your jurisdiction provides otherwise.

Nothing in these Terms is intended to deprive a consumer of rights or protections that cannot lawfully be waived.

23. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

Any invalid provision will be interpreted or limited as closely as reasonably possible to its intended effect.

24. Entire agreement

These Terms, together with the applicable Refund Policy, Privacy Policy, EULA, and any product-specific terms presented at purchase, form the agreement between you and Paper Cat Audio concerning the applicable transaction and use of our services.
